Terms of Service

The legal agreement between you and Spark: Learning Adventures. Built and operated in South Africa under the laws of the Republic of South Africa.

Governed by South African law Effective 1 May 2026 Version 1.0

1. Who these Terms apply to

These Terms of Service ("Terms") are a legal agreement between you ("you", "parent", "guardian") and Spark: Learning Adventures ("Spark", "we", "us"), a sole proprietorship based in South Africa.

By creating a Spark account you confirm that:

  • You are 18 years or older
  • You are the parent or legal guardian of the child profile(s) you create
  • You have the authority to bind yourself to these Terms
  • You have read and accepted our Privacy Policy at sparkwli.online/privacy

These Terms apply to both Spark Home (app.sparkwli.online) and Spark School (school.sparkwli.online).

2. The service

Spark is a web-based educational game platform aligned to the South African CAPS curriculum for Grades 1–4. We provide:

  • CAPS-aligned educational games across Mathematics, English Home Language, Life Skills, and Natural Sciences
  • A Dynamic Difficulty Adjustment (DDA) engine that adapts game difficulty to each child's performance
  • A parent dashboard showing your child's CAPS progress, session history, and achievements
  • A gamification system including XP, levels, badges, quests, and Sparky avatar customisation
  • Offline gameplay support via service workers for use during load shedding

Spark is a web app — no installation required. It runs in any modern browser on phones, tablets, and computers.

We reserve the right to update, modify, or discontinue any feature of the platform at any time. We will give reasonable notice of material changes that affect your subscription.

3. Accounts and access

3.1 Parent accounts

One parent account per household. You are responsible for keeping your login credentials secure. You must notify us immediately at hello@sparkwli.online if you suspect unauthorised access.

3.2 Child profiles

You may create up to the number of child profiles permitted by your subscription plan (1 profile on Spark Plus Monthly/Annual, 3 profiles on the Family Plan). Child profiles are linked to your parent account and are your responsibility.

3.3 Parent PIN

A 4-digit PIN is required to exit a game session or change parental controls. You are responsible for keeping this PIN secure and not sharing it with your child.

3.4 Account security

You are responsible for all activity that occurs under your account. Spark uses Supabase Auth for authentication. Sessions time out after 10 minutes of inactivity on the parent dashboard.

4. Subscriptions and billing

4.1 Plans

Spark Home offers the following subscription plans:

  • Free tier: Grade 1 Mathematics only, limited to 5 games, no parent dashboard
  • Spark Plus Monthly: R49/month — all grades, all subjects, full gamification, parent dashboard
  • Spark Plus Annual: R349/year — same as monthly at a discount
  • Family Plan: R499/year — up to 3 child profiles, all grades, all subjects

4.2 Payment

All payments are processed by PayFast, a South African payment gateway. By subscribing you authorise PayFast to charge your chosen payment method on a recurring basis at the start of each billing period.

4.3 Recurring billing

Subscriptions renew automatically. Monthly plans renew every 30 days. Annual plans renew every 12 months. You will not receive a separate renewal notice — your consent to recurring billing is given at the time of initial subscription.

4.4 Price changes

We will give at least 30 days' notice of any price increase via email to your registered address. Continued use after the notice period constitutes acceptance of the new price.

4.5 Cancellation

You may cancel your subscription at any time from your parent dashboard or by emailing hello@sparkwli.online. Cancellation takes effect at the end of the current billing period. Your access continues until that date.

4.6 Refunds

We do not offer refunds for partial billing periods already paid, except where required by the Consumer Protection Act 68 of 2008. If you believe you are entitled to a refund under South African law, contact us at hello@sparkwli.online.

4.7 Free tier

The free tier is provided as-is with no guarantee of continued availability. We reserve the right to modify or remove free tier access at any time with 30 days' notice.

5. Acceptable use

You agree not to:

  • Use Spark for any purpose other than the lawful education of your child
  • Attempt to reverse engineer, decompile, or copy any part of the platform
  • Share your login credentials with anyone outside your household
  • Use automated tools, bots, or scripts to interact with the platform
  • Attempt to circumvent the DDA engine, XP system, or any gamification mechanic
  • Upload or transmit any harmful, offensive, or unlawful content
  • Attempt to access another user's account or data
  • Use the platform in any way that could damage, overload, or impair our servers

Violation of these terms may result in immediate account suspension without refund.

6. Intellectual property

All content on the Spark platform — including but not limited to game content, CAPS curriculum materials, the Sparky character and all visual designs, the SA World Map and province illustrations, XP and badge systems, audio, and all software — is owned by or licensed to Spark: Learning Adventures.

You are granted a limited, non-exclusive, non-transferable licence to use the platform for the personal, non-commercial education of your child during the period of your active subscription.

You may not reproduce, distribute, modify, or create derivative works from any Spark content without our written permission.

7. Children and parental responsibility

You are the parent or legal guardian of the child using Spark. You accept full responsibility for:

  • Your child's use of the platform
  • Ensuring your child uses Spark appropriately
  • Setting and monitoring session time limits and grade locks from your parent dashboard
  • Keeping your parent PIN secure

Spark provides parental controls — daily time limits, grade lock, and session PIN — but enforcement depends on you using them.

8. Privacy and data

Your use of Spark is governed by our Privacy Policy at sparkwli.online/privacy. Key points:

  • All data is hosted in South Africa on domains.co.za servers
  • We collect only what is necessary to run the platform
  • We do not sell data or use it for advertising
  • You can delete all data from your parent dashboard at any time
  • We are compliant with the Protection of Personal Information Act 4 of 2013 (POPIA)

9. Service availability

We aim to provide a reliable service but do not guarantee 100% uptime. The platform may be unavailable due to:

  • Scheduled maintenance (we will give advance notice where possible)
  • Unplanned outages at our hosting provider (domains.co.za)
  • Load shedding or internet connectivity issues on your end (offline mode via service worker mitigates this for game content already cached)
  • Force majeure events

We will not issue refunds for service downtime unless the outage is sustained (more than 72 consecutive hours) and caused by factors within our control.

10. Limitation of liability

To the maximum extent permitted by South African law:

  • Spark is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform
  • Our total liability to you for any claim is limited to the amount you paid us in the 3 months preceding the claim
  • We do not warrant that the platform is error-free or that content is free from inaccuracies

Nothing in these Terms limits liability for gross negligence, fraud, or any liability that cannot be excluded under the Consumer Protection Act 68 of 2008.

11. Spark School — additional terms

If your child accesses Spark through a school licence:

  • The school is the contracting party with Spark, not you
  • The school is the Responsible Party for your child's data under POPIA
  • A separate Data Processing Agreement (DPA) governs the school's use of Spark
  • These Terms apply to your use of the parent view of Spark School
  • The school's own terms and POPIA compliance obligations govern the school's responsibilities to you

12. Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance. If you do not accept the new Terms, you may cancel your subscription before the effective date.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms will be subject to the jurisdiction of the South African courts.

Before initiating legal proceedings, you agree to first contact us at hello@sparkwli.online to attempt to resolve the dispute informally. We will respond within 10 business days.
